If the insurance company is pushing you to use their preferred body shop, the insurer likely has an arrangement with the body shop for reduced prices on parts and labor in exchange for referrals to their shop. While the insurer and body shop are busy scratching each other’s backs, you may not get the possible best repairs to your vehicle.
You don’t have to use the insurer-preferred shop. Under Texas law, you have the right to select where your car is repaired, and the parts used for the repairs. However, an insurance company is not required to pay more than a “reasonable amount” for the repairs and parts.
For reference, your rights concerning vehicle repairs are contained in Sections 1952.301–1952.307 of the Texas Insurance Code.
